From a tax filing point of view, am I considered legally separated by having filed for divorce?
Q. My husband and I separated in Dec. 2006. I finally filed for divorce (that he asked for) in March 2007 in our home state of California. He and I have not lived together as husband and wife since the separation, but the divorce is far from being final. Are we considered legally separated and can I file my 2007 taxes as single or head of household? Or must I still file married filing separately?

A. No, you are not considered legally separated unless you have a decree of divorce or separate maintenance. You must file as MFS. You may file as HoH if you qualify for that status but you may NOT file as Single.

Is there any consequences in filing married filing separately than jointly?
Q. My tax accountant is telling us that we wouldn't owe as much taxes if we filed married filing separately. Is this legal? My wife and I have 1 child and she sold some stock options last year. We would owe much more if we filed jointly rather than separately. Is this legal? Thanks all! Chip

A. In most cases, MFJ works out better because the tax on income is lower, however, in rare cases, MFS is better.. I am sure your tax accountant wouldn't have suggested it if that was not the case. I do suggest you have her explain to you why MFS is a better situation for you. Best Wishes.

When filing taxes, how do you treat a restocking fee for a returned laptop bought for business?
Q. I am self-employed. I bought a laptop last year for my business, which I had to return soon later because of problems it was having. I was charged a hefty restocking fee for the return. Can I consider this restocking fee a business expense when filing my taxes?

A. Yes. Technically, it is a "service charge" imposed by the company that restocked it for you. You would treat it as any other service charge by any other vendor. I disagree with the other poster who says if you used it only half for business, that you can only write off half of the restocking fee. If the restocking fee was assessed to your business, then you can comfortably deduct the entire restocking fee.
